Terms of Service

By engaging with GUANGZHOU EASTLUCKY Cap & Garment Co., Ltd. ("EASTLUCKY," "we," "us," or "our") for manufacturing services, you ("Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

These terms apply to all business relationships, including but not limited to:

• OEM (Original Equipment Manufacturing) services
• ODM (Original Design Manufacturing) services
• Custom cap manufacturing and embroidery services
• Sampling and prototyping services
• Consultation and design support services

If you do not agree to these terms, please discontinue use of our services immediately.

EASTLUCKY provides comprehensive cap manufacturing and embroidery services, including:

We maintain the right to refuse services that violate applicable laws, infringe intellectual property rights, or fall outside our manufacturing capabilities.

All quotations are estimates based on provided specifications. Final pricing may be adjusted if:

• Material costs fluctuate significantly
• Design complexity exceeds initial assessment
• Additional services are requested
• Delivery timeline requires expedited processing

Orders become binding upon our written acceptance and receipt of required deposits. Cancellation fees may apply for orders in production.

Late Payment: Interest charges of 1.5% per month may apply to overdue balances. Orders may be suspended for accounts with outstanding payments.

Currency: All prices quoted in USD unless otherwise specified. Exchange rate fluctuations are the client's responsibility.

Taxes & Duties: Clients are responsible for all applicable taxes, import duties, and customs fees in their jurisdiction.

EASTLUCKY respects intellectual property rights and expects the same from our clients. By providing designs or specifications, you represent and warrant that:

• You own or have licensed rights to all intellectual property provided
• Use of provided materials will not violate any third-party rights
• You will indemnify EASTLUCKY against any IP infringement claims
• You authorize us to manufacture products using your provided designs

Confidentiality: We maintain strict confidentiality regarding client designs, specifications, and business information. Our team signs non-disclosure agreements and implements secure data handling procedures.

Design Ownership: Custom patterns and technical specifications developed exclusively for your project remain your intellectual property. General manufacturing techniques and processes remain EASTLUCKY's proprietary knowledge.

EASTLUCKY maintains rigorous quality standards through our certified manufacturing processes:

Quality Control Process:

• 12-step production process with built-in quality checkpoints
• Pre-production sample approval required
• In-line inspection during manufacturing
• Final quality inspection before shipment
• Random sampling and testing procedures

Defect Resolution: Products not meeting agreed specifications will be replaced or repaired at our expense. Claims must be reported within 30 days of delivery with photographic evidence.

Shipping Terms:

• FOB Guangzhou port unless otherwise agreed
• Client responsible for freight and insurance costs
• Express shipping available for samples and small orders
• Tracking information provided upon shipment

Delivery Risk: Risk of loss transfers to the client upon delivery to the shipping carrier. We recommend comprehensive insurance coverage for international shipments.

Delays: While we strive to meet all delivery commitments, EASTLUCKY is not liable for delays caused by force majeure events, material shortages, or circumstances beyond our reasonable control.

Warranty Limitations:

• Warranty applies only to manufacturing defects, not normal wear and tear
• Damage from misuse, improper care, or modification voids warranty
• Color variations within industry standards are not considered defects
• Claims must be made within 30 days of discovery

Liability Limitation: EASTLUCKY's total liability for any claim shall not exceed the value of the specific order in question. We are not liable for indirect, consequential, or punitive damages.

Indemnification: Client agrees to indemnify EASTLUCKY against claims arising from:

• Intellectual property infringement
• Product liability claims related to design specifications
• Regulatory compliance issues in the client's market
• Misrepresentation of product capabilities or certifications
